TERMS & CONDITIONS

By booking and paying for an experience with StarfieldConnects Ltd., you agree to and accept the following terms and conditions. This agreement is between you, the participant or their legal guardian (henceforth referred to as “you”) and StarfieldConnects Ltd., 111 Nisbet Blvd., Ontario, Canada, L8B 0L4(henceforth referred to as “StarfieldConnects”). If you are a minor then this agreement MUST BE signed and authorized by your legally authorized guardian. Additionally; all minors must be accompanied by an assigned legal guardian which is usually provided by the school/university which the student is attending.

BOOKING AND PAYMENTS

  1. To make a booking and guarantee your seat on any StarfieldConnects experience, you must agree to the terms and conditions listed below, and provide payment in full prior to departure. StarfieldConnects accepts a booking on the understanding that full payment has been collected and held either by StarfieldConnects directly, or by one of our authorized sales agents or partners. Payment needs to be recorded as paid to TrekkSoft, an authorized agent of StarfieldConnects. Subsequently, it is TrekkSoft that will appear on the customer's credit card statement in the case of an online transaction/purchase.
  2. The services of StarfieldConnects Ltd. are only available to participants residing outside of Canada. We do not take reservations nor do we conduct tours for residents of Canada.
  3. Upon confirmation of your booking and receipt of full payment, subject to availability and at the discretion of StarfieldConnects, StarfieldConnects will reserve your seat on the selected trip. It is the responsibility of you, the customer, to check the accuracy of the booking and the dates of travel.
  4. Upon confirmation of your booking, StarfieldConnects will issue you a confirmation number and/or e-ticket. This confirmation number is required for participation in the selected experience.
  5. By booking any product through the StarfieldConnects website, you provide your permission for StarfieldConnects to contact you by email.

EXPERIENCE DESCRIPTION

  1. Unless otherwise stated in the experience description, StarfieldConnects provides round-trip transportation on a private chartered bus, and quad hotel accommodation for the specified number of nights of the trip. In the case of student trips StarfieldConnects generally provides transportation authority approved school buses.  Hotel accommodation varies from hotel to hotel and can include but is not limited to 2, 3, or 4 person hotel rooms. Room preference is subject to availability and is on a first come first serve basis upon arrival at the hotel by the StarfieldConnects group.
  2. All StarfieldConnects trips include a travel advisor/facilitator to help you with the basic logistics of your trip. The travel advisor will, assist you during check in at the provided accommodation and provide you with basic information concerning recommendations of what to do and what to see. StarfieldConnects travel advisors are NOT professional guides, are not responsible for providing guided excursions, walking experiences or anything other than advice with the basic logistics of your trip. At no time will StarfieldConnects advisors be held liable for the advice they provide to you.

CONTRACTING PARTIES

  1. StarfieldConnects may choose to use an electronic waiver service and you will be asked to sign an electronic waiver which shall  be deemed to be the contract between you and StarfieldConnects.
  2. The booking conditions detailed herein contain the entire contract between you and StarfieldConnects. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation.
  3. Your contract is with StarfieldConnects Ltd. StarfieldConnects reserves the right to nominate to you in writing any other company or person to have the benefit of some or all of the provisions of this contract, which StarfieldConnects may then specify, as if you had agreed to the provisions concerned directly with that company or person.
  4. StarfieldConnects acts as a booking agent and contracts directly with airlines, buses, accommodations (which could include hostels, hotels or other suitable accommodations) and other service providers. All bookings with carriers and other service providers are subject to their terms and conditions and limitations of liability. It is important to note that some of these limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage. StarfieldConnects cannot accept any responsibility for any loss as a result of such actions or as a result of any act or omission of any such third parties.
  5. Many accommodation arrangements provided by StarfieldConnects are contracted to third party providers. They are subject to the terms and conditions, and limitations of liability, imposed by the provider. All arrangements are made independently of StarfieldConnects, regardless of the booking of such arrangements by StarfieldConnects. By booking and paying for an experience with StarfieldConnects Ltd., you agree to and accept the following terms and conditions. This agreement is between you, the participating passenger (henceforth referred to as “you”) and StarfieldConnects Ltd., 111 Nisbet Blvd, Waterdown, Ontario, Canada, L8B 0L4 (henceforth referred to as “StarfieldConnects”).

PARTICIPANT RESPONSIBILITIES

  1. It is your responsibility to make sure you have a valid passport, and all necessary visas, permits or certificates on your person for your selected trip. StarfieldConnects is not liable for any problems, delays or denied entry in the event you are not in possession of valid travel documents.
  2. You agree to comply with the authority of the StarfieldConnects travel advisor, and the laws and regulations of the countries visited, including customs and foreign exchange restrictions. If you do not comply with said reservations, you will be asked by the StarfieldConnects travel advisor to leave the experience. You are not eligible for refunds under such circumstances.
  3. There may be times when the StarfieldConnects travel advisor must make a decision for the safety and/or the best interests of the group. It is a condition of booking that you comply with the authority and decisions of the StarfieldConnects travel advisor. If you do not comply, or if in the opinion of the StarfieldConnects travel advisor you are not compatible with the general enjoyment of the group or the smooth operation of the experience, StarfieldConnects reserves the right to refuse to allow you to continue with the experience. You agree that StarfieldConnects has the exclusive right to expel you from a experience at anytime, without any claims or complaints by you against StarfieldConnects. In such a case StarfieldConnects will not be liable for any refund, compensation, or additional costs incurred by you.
  4. It is your responsibility to meet the transportation provided by StarfieldConnects at the correct time and location for departure. In the event you miss a planned departure, any extra travel costs incurred are paid by you. Passengers who miss a departure time due to delay or cancellation of incoming transportation are not entitled to a refund. It is your responsibility to check in with the StarfieldConnects travel advisor 15 minutes prior to the specified departure time. Due to the nature of the services provided, StarfieldConnects will not be liable if any service departs or arrives later than the specified time, even if as a result you miss a connecting service.
  5. StarfieldConnects may not be held responsible for your personal belongings. It is your responsibility to look after your belongings yourself. StarfieldConnects cannot be held responsible for loss, theft or damage to any of your personal belongings, regardless of the circumstances.
  6. The products offered by StarfieldConnects are experience packages consisting of transportation and accommodation and meetings with organizations. StarfieldConnects makes every effort to accommodate physical disabilities but some components of the experience may be limited due to the accessibility of the hosting organization. StarfieldConnects travel advisors cannot offer constant special attention or assistance should you have any physical disability requiring such attention.
  7. You agree that StarfieldConnects may take photographs and films of you while you are participating on a StarfieldConnects trip. You agree that these images may be used for marketing purposes by StarfieldConnects. These images may be used in, but are not limited to, brochures, websites, print media and promotional videos. These images may be used for publicity and advertising without StarfieldConnects obtaining further consent or payment for the use of the images.

LOCAL EXPERIENCES AND EXCURSIONS

  1. You will have the opportunity to purchase from StarfieldConnects local experiences and/or excursions at your chosen destination. Experiences and excursions are not included in the price of your travel package (unless otherwise stated). You are responsible for any additional costs.
  2. Any experiences and excursions purchased by you are run by local operators and you will be subject to their terms and conditions.
  3. Local experiences and excursions purchased through StarfieldConnects are non-refundable and non-transferable. It is your responsibility to meet the experience at the designated departure point and time.
  4. It is your responsibility to keep track of any local experience and excursion vouchers or tickets issued to you by StarfieldConnects. Lost vouchers or tickets cannot be replaced.

INSURANCE

  1. There is no travel insurance included in the cost of any StarfieldConnects experience or package, ticket, or product.
  2. StarfieldConnects highly recommends that you purchase your own travel insurance that covers all of your travels. StarfieldConnects strongly recommends that you are covered by a comprehensive insurance policy which includes: personal accident, medical expenses, personal baggage, money and public liability.
  3. It is recommended that you acquire trip cancellation insurance from an independent insurance provider if your circumstances indicate that there is a possibility that you might not be able to attend a StarfieldConnects Ltd. experience. (Please see section 8.4 regarding cancellations)

WEATHER, ENVIRONMENTAL AND POLITICAL CONDITIONS

  1. StarfieldConnects may not be held responsible for any delay, deviation, or cancellation due to weather conditions. No trip may be cancelled or changed by you at anytime on the basis of weather conditions.
  2. StarfieldConnects may not be held responsible for delays due to labor disputes, border problems or other political factors.
  3. StarfieldConnects may not be held responsible for delays due to mechanical failure, or other issues that may arise and are outside of our control.

CANCELLATIONS/CHANGES

  1. Any discounted fares, promotion fares, sale fares and package deals are non-transferable and non-refundable.
  2. Promotional trips as prizes have no cash value and are non-transferable.
  3. Vouchers / Gift Certificates are non-refundable.
  4. Cancellation/change of a booking by you must be made in writing or via email to StarfieldConnects prior to 90 days before the trip is to depart. After that there are no refunds or changes permitted.
  5. There will be NO REFUNDS due to denial of VISA’s or inability to obtain a passport or other necessary travel documents.
  6. The payment schedule illustrated in the table below reflects the standard payment terms offered by StarfieldConnects Ltd.


What this table means is:

  1. If you purchase your trip prior to 90 days before departure you must provide a deposit of 10% and agree to the remaining payment due dates and amounts of:
    1. 30% due 90 days before departure,
    2. 30% due 60 days before departure,
    3. 30% due 30 days before departure
    4. Refunds are permitted prior to 90 days before departure
  2. If you purchase your trip between 90 days and 61 days prior to departure you must provide a deposit of 40% of the trip and agree to the remaining payment due dates and amounts of:
    1. 30% due 60 days before departure,
    2. 30% due 30 days before departure
    3. No refunds at this point
  3. If you purchase your trip between 60 days and 31 days prior to departure you must provide a deposit of 70% of the trip and agree to the remaining payment due dates and amounts of:
    1. 30% due 30 days before departure
    2. No refunds at this point
  4. If you purchase your trip between 30 days and the departure date you must pay in full at the time of booking.
    1. No refunds at this point

PLEASE BE AWARE THAT THE PAYMENT TERMS AND CONDITIONS IS A CONTRACTUAL AGREEMENT BETWEEN YOU AND STARFIELDCONNECTS LTD.

    1. No refunds will be made in respect of any unused portion of an experience or partially completed trip.
    2. Experiences may be cancelled/changed by StarfieldConnects due to lack of the minimum number of participants or other unforeseen circumstances.  StarfieldConnects reserves the right to cancel/change experiences up but not less than 12 hours in advance. In the event a experience is cancelled/changed, you will be notified via email or phone. In the event of a cancellation by StarfieldConnects you will receive a full refund for the amount paid.
    3. Changed reservations become ineligible for refunds.

DISPUTE RESOLUTION

  1. This Agreement will be construed and interpreted in accordance with the laws of the Province of Ontario. The parties hereby irrevocably and exclusively attorn to the jurisdiction of the Ontario Superior Court of Justice at Toronto in which event the parties attorn to the non-exclusive jurisdiction of the Ontario Superior Court of Justice.
